General Terms and Conditions
We are pleased that you will be travelling with WanderLust . Please read the following General Contract and Travel Conditions carefully.

1. Scope
These General Terms and Conditions govern the contractual relationship between you and WanderLust respect of the package trips, day tours and other travel services we offer.

2. Conclusion of a contract
A tour reservation / booking is a binding contract for the passenger and the travel agency. A contract is concluded once WanderLust has accepted your booking in our booking system through the Internet and we have confirmed the reservation via e-mail.

  1. Terms of payment
    In general, package trips must be paid for at the time of booking. Prices are normally quoted in ISK inclusive of VAT.
  2. Cancellation and alteration by the customer
    If you wish to cancel or alter your booking, we will levy a processing fee of 8000 ISK per cancellation or alteration. You must notify us of your cancellation without delay, either in person or by or e-mail.The following cancellation charges will apply in addition to the processing fee (above):

28 – 14 days before start of trip: withhold of 50% of travel price
14 – 4 days before start of trip: withhold of 75% of travel price
4 – 0 days before start of trip: withhold of 100% of travel price
No-shows will be treated as cancellations.

We recommend you check your travel insurance, especially travel cancellation insurance.
If you are unable to travel, you can in principle appoint a replacement who will take part in the trip under the same conditions. This is subject to the replacement person agreeing to pay the price of the trip and to the travel providers for the trip accepting the change.

5. Programme alterations and cancellation of trip by the provider
Trip programmes may be altered in unforeseeable circumstances. WanderLust will do all it can to offer alternative, equally satisfactory arrangements or another solution in such cases.

Should the arrangements actually provided be of lesser value than the arrangements originally planned, the difference will be refunded to you if WanderLust or another provider were at fault.

WanderLust is entitled to cancel trips in cases of force majeure (e.g. natural catastrophes, unrest, strikes) or in the event of government action, accidents, technical defects etc. If WanderLust cancels the trip before it begins, the amount you have already paid will be refunded.

6. Complaints
If the trip does not meet the contractual agreement, or if you suffer losses, you are entitled and obliged to notify the relevant service provider of the relevant shortcoming or losses without delay.

Should the service provider at the location be unable to find a satisfactory solution, and therefore the shortcoming is not (properly) resolved, you should complain in writing to WanderLust within 30 days of the date on which the trip was due to end.

You will automatically lose any entitlement if you do not complain to the service provider at the location or send a written complaint to WanderLust within the time allowed.

  1. Participants’ obligations
    Participants are obligated to abide by the instructions of the tour guide or the personnel of the party with whom the travel agency has business.

If passenger is in breach in this respect or who at the beginning of tour indicates that he/she will cause disturbance to the follow travelers by means of conduct, the travel agency is authorized to prevent him/her from embarking or continuing the journey, in which instance the relevant passenger must complete it at his/her own expense, without any right to claim reimbursement by the travel agency.
The travel agency is authorized to refuse accepting the business of persons on grounds of their previous offences and to reject the business of persons who the travel agency deems as being unable to travel, for example, on grounds of illness etc.

  1. Limited liability and damages
    Participants have the option of purchasing at their own expense a travel, accident/illness and luggage insurance through the travel agency or with the insurance companies. Additionally, cancellation insurance as such protection is not included in the price of a tour.

The travel agency furthermore reserves the right to limit the payment of damages in conformity with the limitations as provided for by national law or international agreements.

The travel agency assumes that the participants in group tours enjoy such good health that there is not risk of them causing discomfort to others or delaying the tour because of an illness. A passenger taking ill during a group tour is personally responsible for the costs derived thereof, as well as the expenses for returning home. A passenger does not have the right to reimbursement if he/she does not complete a tour for these reasons or other reasons for which the travel agency cannot be blamed.

A passenger suffering injury or damage to property because a tour is unsatisfactory has the right to the payment of damages except in instances where:

  • A default of contract cannot be traced to negligence by the travel agency or another service party;
    •    the default is caused by the passenger or a third party who is not connected to the service as agreed upon and the default was unforeseeable or unavoidable, or
    •    the default is due to circumstances or events out of the control and could not be foreseen or prevented by the service provider.9. Applicable law and place of jurisdiction
    The contractual relationship between you and WanderLust is subject to Icelandic law. The city of Reykjavík is the sole place of jurisdiction for any disputes arising.
